These terms apply every time you access HATI and encompass all HATI brands, products, and services. Here are the key points:
1. Age Restriction: HATI Services are not for use by individuals under the age of 18.
2. Content Responsibility: While we do not monitor content continuously, we reserve the right to remove any content at our discretion if notified or if we deem it inappropriate.
3. Data Usage: For details on how we handle your personal data, please consult our Privacy Policy. By using HATI, you consent to the use of your data as outlined in this policy.
4. Prohibited Actions: You agree not to use HATI for any activities that are unlawful, misleading, malicious, or discriminatory.
HATI is a social application that features social networking, chatting, and live broadcasting. As such, you are expected to use HATI solely for its intended purposes in compliance with these terms and conditions.
These Terms are binding every time you interact with HATI, regardless of whether you are registered with us. By accessing, using, registering for, or receiving services provided on HATI (collectively referred to as "Services"), you acknowledge and consent to be bound by these Terms.
IF YOU DO NOT ACCEPT AND AGREE WITH THESE TERMS, YOU ARE REQUIRED TO CEASE ACCESS AND NOT UTILIZE THE APP OR WEBSITE.
Your privacy is a priority for us. Our Privacy Policy is designed to provide clear information on how you can use HATI to interact with others and how we handle your content and personal data. We strongly recommend reading the Privacy Policy to understand the implications for your data and to assist you in making well-informed choices.
On HATI, you retain ownership of all types of content ("Content") you upload, and you can manage its visibility through your privacy and application settings. However, it is crucial to follow community guidelines concerning acceptable content. When posting or sending content on HATI, ensure it does not:
1. Use profanity or offensive language likely to disturb or offend others.
2. Display obscene or indecent images or descriptions.
3. Promote abuse, threats, racism, sexism, hatred, or bigotry.
4. Advocate or encourage illegal acts, including terrorism or racial hatred.
5. Spread defamatory statements.
6. Engage in commercial solicitation, including sales promotions, advertisements, or link to external sites.
7. Distribute spam or unsolicited communications.
8. Contain harmful software such as viruses, spyware, or other damaging files that could disrupt functionality.
9. Infringe on the rights of third parties, including privacy and intellectual property rights.
10. Depict or promote drug use.
11. Share political content.
12. Include images or videos of individuals without their consent.
13. Post content deemed negative or inappropriate by HATI.
14. Discuss or display minors in an unauthorized manner.
We value your feedback on HATI, though we may use your suggestions without obligation to compensate you, just as you are not obligated to provide them.
Be mindful of the content you choose to share on HATI, as you are solely responsible for it and any consequences that may arise.
We are committed to respecting the rights of others and maintaining a safe platform on HATI, and we expect the same from our users.
1. Content Restrictions: Do not post or engage in activities on HATI that infringe or violate another person's rights or the law.
2. Content Moderation: We reserve the right to remove any content or information you post on HATI if it is believed to violate our Terms or policies.
3. Dispute Resolution: If your content is removed due to a copyright claim and you believe this was in error, we will provide an opportunity for you to appeal the decision.
4. Repeat Infringement: Should you repeatedly violate intellectual property rights, we may disable your account as deemed necessary.
5. Trademark Usage: You are not permitted to use our copyrights, trademarks, or any similar marks without our express prior written consent.
6. Data Collection from Users: If you collect data from users, ensure you have their consent, clarify that you are the one collecting their information (not HATI), and publish a privacy policy detailing what information is collected and how it will be used
7. Sensitive Information: Do not post or share anyone's identification documents or sensitive financial information on HATI.
8. Consent for Tags and Invitations: Do not tag users or send invitations to non-users without their express consent.
HATI requires users to register using basic information like nickname, age, gender, and avatar, along with other optional details. To maintain the integrity of our platform, here are the commitments you must adhere to when registering and securing your account:
1. Age Requirement: You must not use HATI if you are under the age of 18.
2. Account Transfer: Your account cannot be transferred to anyone else without our explicit written permission.
3. Accuracy of Information: You must not provide false information on HATI, nor create an account for anyone other than yourself without authorization.
4. Disabled Accounts: If your account is disabled, you are prohibited from posting any content on HATI, with the exception of communicating with the HATI Team for assistance.
5. Account Termination: We reserve the right to terminate or ban your account if deemed necessary.
If you breach our Terms, or if your actions pose legal risks or complications for us, we hold the right to take action at our discretion without prior notice or liability, including without obligation to refund for any services not used. This may include:
1. Suspending or Revoking Access: We may suspend or terminate your registration and your rights to access or use HATI, or to submit any content to HATI.
2. Enforcing Terms: We may implement any operational, technological, or legal measures necessary to enforce the Terms, such as blocking specific IP addresses.
While we will attempt to inform you of any action taken against your account or profile, we are not obligated to do so.
Voluntary Termination by Users: You may terminate your registration with HATI at any time by contacting us at support@hati-chat.com. Upon termination, we reserve the right to delete any content you have submitted or uploaded to HATI. Please see our Privacy Policy for more details. Note that content you have uploaded, other than your profile (such as moments, comments, or contacts), may remain visible on HATI even after your registration is terminated.
In-App Purchases: HATI occasionally offers additional products and services for purchase through app marketplaces such as the App Store℠ and Google Play ("in-app purchases"). If you decide to make an in-app purchase, you will be required to provide your account details for the platform you are using (e.g., Apple, Android, etc.) ("your IAP Account"). Charges for these purchases will be made to your IAP Account according to the terms presented at the time of purchase and the general terms for in-app purchases associated with your IAP Account.
Subscription Services: If you opt for an auto-renewing subscription through an in-app purchase, your IAP Account will incur recurring charges until you cancel the subscription in line with the platform's terms.
Platform Terms: For all in-app purchases, please consult the terms and conditions of the platform from which you make the purchase, as these will govern your transactions.
On HATI, you have the option to pay for enhanced services to enrich your experience on the platform. Among these services, HATI provides unique opportunities for users to connect and interact more effectively with others. One feature includes the ability to purchase virtual currency, referred to as HATI coins. These coins can be used within the app to send gifts and participate in various interactive activities. Additionally, HATI offers a subscription service for messaging that allows subscribers to receive complimentary message rewards on a weekly basis.
1. Renewal Policies: Subscriptions will renew automatically unless auto-renewal is disabled at least 24 hours before the current subscription period expires.
2. Billing: Charges for renewal will be applied to your account within 24 hours before the current period ends, with details provided on the renewal cost.
3. Management of Subscriptions: Users have the ability to manage their subscriptions, including turning off auto-renewal, by accessing their settings in the App Store or Google Play.
4. Cancellation Restrictions: Canceling a current subscription during an active period is not permitted.
1. Purchasing and Using HATI Coins: HATI allows you to buy virtual currency, termed "HATI Coins," which you can use within the Service for activities such as tipping broadcasters or sending gifts in chat. You agree that any transfer of HATI Coins from your account to another user is final and non-reversible.
2. Acquisition and Value: HATI Coins are virtual assets purchasable through various payment methods including credit/debit cards, bank transfers, digital wallets, Google Payments, and iTunes Payments. The value and exchange rate of HATI Coins, which may vary based on your country, along with any related terms, are determined by HATI and are subject to change at our discretion.
3. Usage Compliance: The use of HATI Coins must be for legitimate purposes within the service and comply with applicable laws. These Coins are not exchangeable for cash or other economic benefits outside of designated services and content on HATI.
4. Currency Source Assurance: By purchasing Coins, you confirm that your funds are obtained legally and are not linked to any illicit or disputed sources. If you are unclear or disagree with our exchange rate policy, or cannot ensure the legality of your funds, please abstain from buying Coins.
5. Terms Updates: HATI reserves the right to modify the Terms of Use or the terms of sale for Coins periodically. You agree to review these terms before making any purchase, as revised terms will apply to subsequent purchases.
6. Account Termination and Coin Forfeiture: If HATI terminates your account for cause, any remaining Coins may be forfeited and are non-recoverable at HATI’s discretion.
7. No Refunds or Disputes: Coins are generally non-refundable and non-disputable; however, exceptions may be made if required by law. In such cases, HATI will provide refund or dispute resolution procedures as per relevant regulations, details of which will be available on the platform.
If you encounter any inappropriate content on HATI, you have the ability to take action directly through our platform. We offer "Block" and "Report" functions that you can use to help maintain the safety and cleanliness of HATI. To report a user or specific content:
● User Reports: You can report a user by clicking the "Report" button on their profile page and selecting the reason for your report.
● Content Reports: To report a specific moment, click the "Report" button on the detail page of the moment and select your complaint reason.
Our "Audit Team" reviews all reports and will take appropriate actions based on our established policies. If you believe an error was made in processing your report, we provide an opportunity for appeal. Please contact us via email at support@hati-chat.com for appeals. We are committed to resolving any issues promptly and efficiently.
1. Content Ownership: HATI does not claim ownership of any content ("Content") you upload or post on the HATI Services. However, by posting Content, you grant HATI a non-exclusive, royalty-free, worldwide license to use, adapt, publicly perform, display, reproduce, and distribute your Content in any media through any media channels, provided that Content marked as "private" will not be distributed outside the HATI Services.
2. Content Responsibility: You assert that you own or have the necessary licenses to use the Content you post, ensuring that such posting does not infringe on any rights, such as privacy, publicity, intellectual property, or others, nor does it breach any contracts. You are responsible for any royalties or fees due because of the Content you post.
3. HATI's Content: The HATI Services include proprietary content owned by HATI ("HATI Content"), protected under copyright and other laws. HATI grants you a limited, revocable license to view and use the HATI Content for personal use in relation to accessing the Services.
4. Restrictions on Content Use: Except as explicitly stated in this Agreement, you are prohibited from copying, modifying, publishing, transmitting, or selling any Content accessed through the HATI Services, whether owned by HATI or licensed from others.
5. Technical Functions and Content Management: HATI performs necessary technical functions to manage the Services, such as transcoding or reformatting Content to ensure compatibility across the Services.
6. Service Availability and Content Deletion: The availability of HATI Services may be interrupted for maintenance, emergencies, or due to technological issues beyond our control. While typically only Content that violates this Agreement will be deleted, HATI reserves the right to remove any Content for any reason. It is advisable to keep personal backups of your Content, as HATI is not responsible for data loss or service interruptions.
HATI, to the maximum extent allowed by law, categorically disclaims:
1. Implied Terms: Any warranties, conditions, representations, or other terms that might be implied by law, common law, or equity are expressly excluded.
2. Liability: Any liability for damages arising from your use of HATI or its services, or from these terms and conditions, including but not limited to direct, indirect, incidental, special, exemplary, punitive, or consequential damages, whether arising through negligence or otherwise. This includes, but is not limited to, losses such as data loss, income or profit loss, damage to property, and losses involving third parties, even if HATI has been advised of the potential for such damages.
The limitations apply broadly to any issues arising from the use of HATI, including, but not limited to, technical malfunctions, unauthorized access, physical injuries not due to our negligence, and acts of God, encompassing loss of business, contracts, goodwill, anticipated savings, and management or office time.
You agree to defend, indemnify, and hold harmless HATI, along with its parent company, officers, directors, employees, and agents, against any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) that arise due to: (i) your use and access of the HATI Service; (ii) your breach of any terms of these Terms of Service; (iii) your infringement of any rights of a third party, including but not limited to copyright, property, or privacy rights; (iv) any damage to a third party caused by your User Status Submissions. This indemnification obligation will remain in effect even after your use of the HATI Service and the termination of these Terms of Service.
This Agreement is governed by the laws of Hong Kong, applying without consideration to its conflict of law principles. Any disputes related to this Agreement, including questions about its existence, validity, or termination, will be exclusively resolved through arbitration. This arbitration will be conducted by the Hong Kong International Arbitration Centre ("HKIAC"), under its current rules, which are incorporated into this clause by reference. The arbitration proceedings will take place in Hong Kong and will be conducted in English.
We reserve the right to update these terms and will provide you an opportunity to review and comment on the revised terms before you continue using our Services. Should there be changes to our policies, guidelines, or any other terms that are referenced in or incorporated by this Agreement, we will notify you on our Website.
